Probate is the legal process of transferring the legal title of property from the estate of the deceased to their beneficiaries. During the probate process the executor of the will goes before the courts and identifies and catalogs all the property owned by the deceased. Property is appraised, all debts and taxes are paid, the will is proved as valid and legal, and property is distributed according to the instructions in the will. Probate can often be a long, drawn-out legal process, but there are some probate-avoidance plans available. Speak to your attorney to find out what you can do to avoid probate in your area.
